Understanding: The terms and conditions below apply to all coaching and mentoring services provided by Kirkland King (“Coach”) to any individual or organization (“Client”) and constitute the contract for the service to be provided by Coach for the client. The term “coaching” as here used covers life coaching, personal coaching, executive coaching and business coaching for clients and where applicable includes mentoring or supervision services provided for clients, coaches or others. Coaching is not psychological counseling or any type of therapy, and should not be construed as such. Life coaching is an alliance between the Coach and the Client in a thought-provoking process that inspires the Client to maximize personal growth. In return for the fees payable by the client (or by a third party on their behalf), Coach agrees to provide the service as described below and in accordance with the terms and conditions set out below. The client agrees to pay fees for the service on the terms and conditions set out below (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the Client). The date that the first coaching session takes place shall be deemed to be the start date for the service. Participation by any individual in the first coaching session constitutes acceptance of these terms and conditions. The client will be required to sign a contract with Coach prior to commencement go coaching.
The Life Coaching Relationship: The Coach serves as your partner in self-discovery, personal growth, goal setting and goal attainment. The Coach’s role is to help the Client discover within yourself the beliefs or issues that are blocking you from getting all you want out of life and to help elicit from you what are your best solutions or new ways of being to live more of the life you desire. Life coaching is not therapy and Kirkland King is not a licensed therapist. A life coach does not diagnose or treat disorders. If you are currently in therapy, you are strongly encouraged to inform your therapist that you are engaged in a life coaching arrangement.
Responsibilities: Coach agrees to maintain the ethics and standards of behavior set by the International Coach Federation (ICF), www.coachfederation.org/ethics. Client is responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions, and results. As such, Client agrees that the Coach is not and will not be liable for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands that coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease. Client understands that coaching is not to be used as a substitute for professional advice by legal, mental, medical, or other qualified professionals and will seek independent professional guidance for such matters. If Client discloses that he/she is currently under the care of a mental health provider, Coach will recommend that Client inform the mental health provider. Coach will seek to enable the Client to set and achieve goals that will help to bring about desired outcomes for the Client. The client has sole responsibility for any decisions they may make following coaching with Coach. Coach accepts no liability for the client’s actions. Coach has no liability for any loss incurred by any client, whether financial or otherwise, following commencement of coaching sessions, or for any perceived failure by the Client, whether justified or otherwise, to achieve a material improvement in quality of life or to achieve their desired outcomes or goals. The Client will be required to complete a Commitment to Coaching form prior to the commencement of coaching; the Client will be asked if they are ready to take action to make the necessary changes.
Services: The parties agree to engage in a Coaching Program as selected by the Client. Meetings will take place over the telephone or skype unless otherwise agreed upon. Coaching is delivered during regularly scheduled sessions as scheduled by the Client. The Client will determine the overall direction of the coaching, its pace, and eventual outcomes based on the Client’s level of commitment and focus during the coaching process.
Payment: Coaching Plan Payments are due prior to scheduling sessions. All plan have a minimum payment due for purchase. Minimum payments due for the plans are as follows; POSSIBILITY Plan, full amount due prior to scheduling, non-refundable. STRUCTURE Plan, Two (2) months payment amount due prior to scheduling, one (1) month non-refundable. COMMITMENT Plan, Two (2) months payment amount due prior to scheduling, one (2) month non-refundable.
Client Responsibilities: In order for coaching to be most effective, the Client must make a commitment to take an active part in the process, which may include identifying your goals and desired outcomes, doing agree-upon homework assignments and follow-up activities on your own time between sessions. As the Client, you supply the agenda or topic of discussion for each session. It is important that you are truthful, open, and authentic, saying what you believe and feel. The Coach will assist you to realize your own potential, and respect your right to make your own informed and responsible decisions; thus, you need to be aware that results cannot be guaranteed, and that you are entering into coaching with the understanding that the effort and energy that you put into coaching will largely determine the outcomes you experience. Coaching Calls: The Client is responsible for selecting the one-on-one or group coaching package which details the call length.
One-on-One Coaching: For one-on-one sessions, the Client will be responsible for scheduling the call time. For all coaching sessions, the Client will call the Coach at the pre-determined time at a phone or Skype number provided by the Coach. If Client is late for a call, the Coach may need to end the session after 15 minutes into the session. Coach retains the right to proceed with session after 15 at coaches digression as lack of time may not allow for a productive session.
Group Coaching: Group coaching call times are listed in the package description. Clients participating in group coaching will call into the telephone or Skype number provided by the Coach at the pre-determined time. Client will be responsible for any long distance charges.
Cancellation & Rearranging Sessions: Client may be responsible for coaching session fees for any scheduled calls that the Client cancels with less than 48 hours notice. Cancellation notice should be given by email. The Coach is under no obligation to reschedule a missed coaching session unless advance cancellation is given. If the client needs to rearrange a coaching session, Client should provide at least 48 hours’ notice. No refunds will be given to Client for unused coaching sessions unless 48 hours’ notice has been given. In exceptional circumstances Coach may need to rearrange a coaching session; in these circumstances, Coach will use reasonable endeavors to provide a mutually satisfactory alternative appointment for the client. Where a client pays for a session, or sessions, in advance they must have the coaching session(s) that they have paid for within 6 months of the payment, or their fee is forfeited.
Termination of Services: Either the Client or Coach may terminate this agreement at any time with one week’s written notice. Any monies owed at the time of cancellation will become due immediately. Refunds on payments made against future sessions will be at the discretion of Coach. The Coach will refund the Client for any unused portion of any pre-paid coaching services. For group coaching, either the Client or Coach may terminate the agreement with one week’s notice prior to the start of the package period. No refunds will be given to the Client once the group coaching sessions have begun. Credit for group coaching sessions may be given at the Coach’s discretion. In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behavior by the client, actual or potential conflict of interest, or other reasons, Coach can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by Coach where practicable and will be refunded any advance payments beyond the nonrefundable portion made for coaching sessions not yet provided. There may be occasions when Coach may recommend to the client that they seek an alternative service more suited to their current needs. In this event, Coach will fully discuss the reasons for the recommendation with the Client. It is the Client’s sole responsibility to decide whether to follow the recommendation and Coach does not accept any liability for the outcome of any decisions the Client chooses to make.
Confidentiality: This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this arrangement, is bound to confidentiality by the ICF Code of Ethics but is not considered a legally confidential relationship (like medicine or law). The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent. Confidential information does not include information that: was in the Coach’s possession prior to its being furnished by the Client; is generally known to the public or in the Client’s industry; is obtained by the Coach from a third party, without breach of any obligation to the Client; and is independently developed by the Coach without use or reference to the Client’s confidential information; or that the Coach is required by law to disclose.
Release of Information: The Coach retains the right to share the Client’s name and number of coaching hours as required for documentation for any coaching certifications. The Coach engages in continuing education pursuing ICF or other credentialing. That process may require the Client’s name, contact information, dates and/or number of coaching hours. By agreeing to these Terms and Conditions, the Client agrees to have only the above-mentioned information shared with the credentialing organization for the sole purpose of verifying the coaching relationship. No personal notes will be shared. According to the ethics of this profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, further coach professional development and/or consultation purposes.
Limited Liability: Except as expressly provided in this agreement, the Coach makes no guarantees or warranties, express or implied. In no event will the Coach be liable to the Client for consequential or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this agreement, and the Client’s exclusive remedy will be limited to the amount paid by the Client to the Coach under this agreement for all services rendered up until the termination date. The Client agrees to utilize these life coaching services will the full understanding that Coach and any employees and volunteers are in no way liable for the Client’s decisions, actions, and outcomes. Client also agrees to hold Coach and any employees and volunteers free of all liability and responsibility for any adverse situations created as a direct or indirect result of a specific referral, advice given or any actions taken while working with or as a direct result with Coach.
This is the entire agreement of the parties and reflects a complete understanding of the parties with respect to the subject matter. This agreement supersedes all prior written and oral representations.
